In France, lending money between individuals is perfectly legal — provided three simple rules are followed.

A written contract from €1,500

Beyond €1,500, French civil law requires a written instrument (acknowledgment of debt or loan contract) for the transaction to be enforceable in court. Kredy generates it automatically, signed electronically by both parties.

A rate capped by law

The interest rate freely agreed between individuals cannot exceed the usury rate published quarterly by the Banque de France. For personal loans under €3,000, it sits around 22–23% in 2026.

A tax declaration from €5,000

Beyond €5,000 lent to the same borrower in a year, the lender must declare the transaction to the tax authorities via form no. 2062 — generated and pre-filled by Kredy for you.

What our simulator doesn't (yet) tell you

01How is the monthly payment calculated?add
We apply the standard fixed-payment amortization formula used by banks: M = P × r / (1 − (1+r)^−n), where P is the principal, r the monthly rate (annual rate ÷ 12) and n the number of payments. Each monthly payment is constant throughout the loan.
02Is the interest rate mandatory?add
No. A peer-to-peer loan can be granted at zero rate — this is in fact the most common case between loved ones. If you set a rate, it simply needs to stay below the quarterly usury rate published by the Banque de France.
03Do I need to declare interest income on my taxes?add
Yes. Interest received by the lender is classified as capital income, subject to a 30% flat tax in France. Each year, Kredy prepares the summary to attach to your tax return.
04Does this simulator replace a contract?add
No. The simulator is only an estimation tool. To formalize the loan, Kredy generates a contract compliant with French law, signed electronically, archived and enforceable in court.
05Can I modify an ongoing loan?add
Yes. From the Kredy app, you can agree with the borrower on an amendment: postponement, rescheduling or early repayment. The amendment is signed electronically and added to the original contract.
06What if the borrower doesn't repay?add
Kredy automatically sends friendly reminders, then, if needed, triggers a formal notice letter drafted by our legal team — enforceable in court — with no lawyer fees.
